Section 1: Introduction and Acceptance

Welcome to LYNA Health. These Terms of Use constitute a legally binding agreement between you and LYNA regarding your access to and use of our digital guardian ecosystem, including our mobile application, concierge services, and wellness science platform.

By accessing or using LYNA, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

Section 2: Definitions

“Service” refers to the LYNA platform, AI guardians, and health coaching. “User” refers to any individual who creates an account. “Content” encompasses all health data, textual information, and personalized insights generated within the ecosystem.

Section 3: Eligibility

You must be at least 18 years of age to use LYNA. By creating an account, you represent and warrant that you possess the legal right and ability to enter into these Terms and to use the Service in accordance with all governing laws.

Section 4: Account Registration and Security

Accessing the LYNA ecosystem requires a secure account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. LYNA utilizes multi-factor authentication to protect your biological and health data.

Section 5: Limited License

LYNA grants you a non-exclusive, non-transferable, revocable license to access and use the Service strictly for your personal, non-commercial health optimization purposes.

Section 7: User Content

You retain all ownership rights to the health data and personal information you provide. However, you grant LYNA a worldwide, royalty-free license to use, process, and analyze this data to provide personalized health insights and improve our predictive models, subject to our Privacy Policy.

Section 9: Payments and Subscriptions

Membership fees are billed on a recurring basis. You authorize LYNA to charge your chosen payment provider. Cancellations must be made through your account settings at least 48 hours prior to the next billing cycle to avoid further charges.

Section 10: Intellectual Property

All software, design elements, “LYNA” branding, and scientific methodologies are the exclusive property of LYNA Health. Any unauthorized use of our intellectual property is strictly prohibited.

Section 11: Privacy

Your privacy is paramount. Please review our Privacy Policy, which is incorporated into these Terms by reference, to understand how we collect, use, and protect your information.

Section 12: Third-Party Services

The Service may integrate with third-party wearables or lab providers. LYNA does not control these external services and is not responsible for their performance or data handling practices.

Section 13: Termination

LYNA reserves the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

Section 14: Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LYNA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Section 15: Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

Section 16: Indemnification

You agree to indemnify and hold LYNA harmless from any claims, damages, or expenses arising from your use of the platform or your violation of these Terms.

Section 17: Modifications to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the Service and updating the “Last Updated” date at the top.

Section 18: Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located within Delaware.

Section 19: Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
